These Terms of Use govern the iOS/iPadOS application “Beyond the Frame” (the “App”) provided by TKLab (the “Operator”).
1. Scope and Agreement
- These Terms apply to use of the App.
- By using the App, you agree to these Terms.
- App Store, iCloud, and other Apple terms also apply where relevant.
2. App Functionality
- The App saves and displays a photo, title, back story, and date as a Polaroid-style card.
- Cards can be flipped by tapping or swiping horizontally.
- The Operator may change functionality, presentation, or supported environments when necessary.
3. Text and Photos
- Current limits are 12 Japanese title characters / 70 Japanese story characters, 20 English title characters / 120 English story characters, and a maximum of 12 story lines.
- You must only add photos, text, or other content for which you have the necessary rights or authorization.
- The App may request Photos or Camera access for selecting or taking a photo.
4. Device and iCloud Storage
- Card data is stored on the user's device and synchronized through the user's own iCloud private database.
- The App does not use a public database or shared database for this card content.
- Sync may occur across supported devices using the same Apple Account, but timing depends on Apple services, connectivity, and other conditions.
- Deleting a card inside the App may synchronize that deletion to iCloud and other devices.
- Device-only data that has not yet uploaded to iCloud may be unrecoverable after device loss, failure, or erasure.
5. TKLab Access
TKLab does not operate its own server or administrative console for viewing or retrieving users' card content and does not access individual photos or stories stored in a user's iCloud private database.
6. Purchase and Payment
- Version 1.1 allows up to 7 saved photo cards for free. A one-time, non-consumable Full Access purchase removes the limit; it is not a subscription. Previous paid-app customers and users who obtain the earlier version during the transition retain unlimited access without an additional purchase. Purchases are processed through Apple's App Store.
- Full Access is an optional one-time in-app purchase. Please check the localized price displayed in the app or App Store before purchase. Use Restore Purchase in Settings to restore an eligible purchase.
- Purchases, billing, refunds, and related matters are subject to Apple's applicable terms and procedures.
7. Prohibited Conduct
You must not violate law or public order, infringe copyright, image rights, privacy, or other rights, interfere with operation of the App, or unlawfully analyze, modify, redistribute, or misuse the App.
8. Intellectual Property
Rights in the App's design, text, and software belong to the Operator or the applicable rights holder. Rights in photos and text added by users remain with the user or applicable rights holder.
9. Data and Disclaimer
- iCloud synchronization is not a versioned backup service.
- The Operator does not guarantee complete preservation, immediate synchronization, or recovery of data stored on the device or in iCloud.
- To the extent permitted by law, the Operator is not liable for damages arising from use or inability to use the App, except in cases of willful misconduct or gross negligence by the Operator.
10. Changes or Discontinuation
The Operator may change or discontinue the App or revise these Terms when necessary. Material changes will be announced on this site or in the App.
